Terms and Conditions of Sale

Please read carefully before attending the sales.

 

 

  1. The highest bidder to be the purchaser and no person shall retract bidding.  The advance on each lot to be determined by the Auctioneers who reserve to themselves the right of refusing any bidding and of altering, adding to, dividing, consolidating, or withdrawing any lot or lots at the Sale.
  2. Should any dispute or difficulty arise between two or more bidders, or otherwise, the lot or lots in dispute may be put up again or the purchaser declared, at the discretion of the Auctioneers, who are to be the sale arbitrators as to the amount of bidding, and every other matter connected with the Sale, and their decision on each and every point in question shall be final and binding on all parties.
  3. All lots to be at the risk and charge of the purchaser from the fall of the hammer, and such lots to be taken away with faults, defects and errors of descriptions, of whatsoever nature, sort or kind without any power of dispute, at the risk and expense of the Purchaser.  NO LOT OR LOTS SHALL BE REMOVED FROM THE PREMISES ON WHICH THE SALE IS HELD UNTIL PAID FOR, nor shall any person be allowed to retract his or her bidding, but give his or her name and address on demand.  Title will not be deemed to have passed until all lots are paid for in full.
  4. The Auctioneers act as agents only.  Each lot as set in the Catalogue or as divided or joined with any lot or lots at the sale at the sole discretion of the Auctioneers, is sold with all faults, imperfections and errors of descriptions, and neither the vendors nor the Auctioneers are responsible for the condition or quality of any lot.  All statements in the catalogue as to any such matters are statements of opinion and are not to be taken as, or implying, statements or representations of fact.  Purchasers are deemed to have satisfied themselves by inspection or otherwise as to all such matters and as to the physical description of any lot, neither the vendors nor the Auctioneers make or give, nor has any person in the employment of the Auctioneers any authority to make or give any representation or warranty, and in any event neither the vendors nor the Auctioneers are responsible for any representation or condition or for any statement in the catalogue.
  5. For all purposes of this Sale, the Auctioneers shall be deemed to be the agents of both vendor and purchaser.
  6. On failure of compliance with these conditions the Auctioneers shall be at liberty to resell the lot or lots without further notice, either by public or private sale, and any deficiency (if any) arising from such second sale, together with all charges and expenses attending the same shall be made good by defaulter at this present sale, and be recovered as and for liquidated damage.
  7. Any damage caused by the removal of lots or otherwise, must be made good by the person committing the same, principal being considered responsible for the acts or their servants.
  8. Every purchaser or intending purchaser comes in on the premises entirely at his, her or their own risk and by so doing they are deemed to have expressly agreed with the vendors and/or Auctioneers that they will not be held responsible for any accident whatever that may occur to any such persons due to any cause whatsoever.
  9. Removal of Lots.  All lots purchased must be removed from the premises by 5.30pm Monday after the sleless previous arrangements have been made.
  10. All lots uncleared within this time aforesaid may be resold either by Public Auction or Private Sale and the deficiency attending such resale shall with the expenses thereof be made good by the defaulted at the Sale
  11. There is a 10% Buyers Premium charged on the purchase price; this is exclusive of V.A.T.
  12. TERMS OF PAYMENT: Cash, Cheque, Credit Card (there is a charge for this service) or Bankers Draft on Day of Sale.  Persons wishing to pay by cheque must be prepared to furnish a letter of credit from their Bank.
